Last Will and Testament
A Last Will and Testament is a legal document that allows you to put your wishes for your estate in writing. It provides instructions for how you want certain property and assets to be distributed after your death and can identify the individuals or organizations you wish to receive those assets.
A Will can also name the person you would like to serve as the Personal Representative of your estate—the individual responsible for handling the administration of your estate according to your instructions and applicable Arizona law. If you have minor children, a Will may also allow you to nominate a guardian to care for them.
Creating a Will can help provide clarity for your loved ones and make your wishes known. It can be especially important after significant life changes, such as marriage, divorce, the birth or adoption of a child, the death of a beneficiary, or changes in your financial circumstances.
A Will generally becomes effective upon your death and may be subject to the probate process. Certain assets, such as those with beneficiary designations or assets held in certain forms of joint ownership, may pass outside of a Will.
